What Factors Determine Your Treatment Level?
State regulators use a combination of objective legal data and clinical insights to assign your path. The primary factors include:
Your Blood Alcohol Concentration (BAC): Was your BAC below, at, or significantly above the legal limit of 0.08%?
Chemical Test Refusal: Did you refuse to take a breath or blood test at the time of your arrest?
Prior Offenses: Have you had a prior DWI conviction within the last 7 years?
Clinical Indicators: Does the clinical interview indicate a mild, moderate, or severe substance use concern?
The 5 North Carolina DWI Education & Treatment Levels

Level 0.1: Alcohol Drug Education Traffic School (ADETS)

Level 1.0: Outpatient Treatment and Services
This level is designed for individuals who require slightly more support and education than the basic ADETS class.
Requirement: Outpatient programs ranging from Short-Term (20 to 39 hours) to Long-Term (40 to 89 hours), completed over a minimum of 30 to 90 days.
Who qualifies: Often triggered by a high BAC (0.15% or higher), a chemical test refusal, a prior history of substance-related issues, or specific clinical assessment indicators.
Level 2.0: Intensive Outpatient Program (IOP)
A highly structured, non-residential treatment program designed for deeper clinical support.
Requirement: A minimum of 90 hours of group and individual counseling, usually completed in 3-hour sessions multiple times per week.
Who qualifies: Mandated for individuals showing signs of clinical substance dependence, multiple offenses, or those who require advanced clinical intervention.
Level 3.0: Inpatient and Residential Treatment Services
This level involves temporarily living at a state-approved treatment facility.
Requirement: A minimum of 90 days of active residential treatment.
Who qualifies: Recommended when outpatient treatments have been unsuccessful, or when a high-security, substance-free living environment is clinically necessary for recovery.
Level 4.0: Medically Managed Intensive Inpatient Services
The highest level of clinical care, focusing heavily on physical safety and stabilization.
Requirement: 24-hour medically supervised clinical care, including daily physician visits.
Who qualifies: Reserved for individuals experiencing severe, acute withdrawal symptoms or co-occurring medical conditions that require immediate stabilization before therapy can begin.
